El transporte terrestre de pasajeros en el territorio nacional español : perspectiva contractual, indemnizatoria y asegurativa

Abstract

RESUMEN: El objeto de la investigación se refiere al transporte terrestre de pasajeros. Se aborda especialmente el ámbito de la contratación del transporte, la responsabilidad civil, la protección del pasajero como consumidor y su aseguramiento. Puede, además, destacarse el estudio detallado de las nuevas formas de transporte colectivo terrestre derivado del movimiento colaborativo y sus implicaciones jurídicas. A lo largo de la presente tesis doctoral hemos pretendido resaltar todas aquellas carencias encontradas en el ordenamiento jurídico español conforme a las cuales resulta difícil garantizar una igualdad de trato entre los pasajeros de los diversos medios de transporte terrestre en el territorio español –principalmente, servicios de transporte ferroviario y por carretera-. Es nuestra intención arrojar algo de luz al confuso panorama normativo que, casi desapercibido para la doctrina ius civilista y lejos de ser resuelto por los legisladores nacional o europeo, se ha instaurado en el ordenamiento jurídico español.

ABSTRACT: The object of the research refers to land passenger transport. The field of transport contracts, liability, consumer’s law protection and insurance are particularly addressed. Also, it may be highlighted the detailed study of the new forms of collective land transport derived from the collaborative movement and its legal implications. Throughout this doctoral thesis we have tried to highlight all the shortcomings found in the Spanish legal system under which it is difficult to ensure equal treatment for passengers of diferent land transport systems in the Spanish territory –mainly, railway and land transport servicies-. It is our intention to shed some light on our confusing legal situation that, almost unnoticed by the ius civilian doctrine and far from being resolved by the national or European legislators, has been established in the Spanish legal system.
