Abstract

RESUMEN: Dos pasajes paralelos de Paulo sobre la imposibilidad de la prestación son objeto de una descomposición analítica que intenta aislar sucesivamente los siguientes elementos: juristas, hechos, soluciones y argumentos. La individualización de los tres primeros puntos sirve par aclarar el modo en que se relacionan, facilita la comprensión del contenido normativo de los textos y permite explicar mejor el entramado argumentativo que tienen detrás. Finalmente se apuntan tres cuestiones derivadas del análisis efectuado merecedoras de una profundización ulterior.

ABSTRACT: Two parallel passages of Julius Paulus on impossibility of performance are subject to an analytical breakdown in order to isolate the following elements: lawyers, facts, solutions and arguments. The individualization of the first three items serves to clarify how they relate, facilitates understanding of the normative content of the texts and allows better explain the argumentative framework behind it. Finally, three issues are mentioned that emerge from the foregoing analysis and deserve more in-depth examination.
