Abstract

ABSTRACT This work deals with the development of the Spanish prison system from the Ancien Régime up to the beginning of the twentieth century. In Spain, the previous criminal speech before the Enlightenment remained under the control of the legal medieval doctrines. Absolutism had virtually the entire judiciary power, which was based on the arbitrariness of judges and unequal social conditions. In addition, the corruption of the judicial machinery was visible throughout its structure. In fact, poor people were the first victim of the social collective being. The theories of punishment arising from the Enlightenment began a process of humanization of the treatment of prisoners. Throughout the nineteenth century, several prison reforms were made to improve the situation of poverty in prisons and its social breakdown. The Prison Law suffered multiple changes in its laws. With each change in Spanish politics, the prison system was transformed, leading to a general slowdown in its progress towards modernity. On the other hand, the prison architecture was evolving gradually. The real problem had its roots in how implement all the ideas that had been collected from the first prison reforms.
