El riesgo de la justicia

Abstract

RESUMEN: Una justicia capaz de afrontar la complejidad del mundo contemporáneo y abordar problemas a gran escala necesita ser concebida en términos de riesgo. Con la pregunta por la justicia el derecho se arriesga, y precisamente al asumir riesgos aparecen nuevas oportunidades. Conceptos como contraste, polaridad, tensión, dialógica, irritación y diferencia son esquemas formales que ofrecen a la teoría de la justicia instrumentos prometedores y muy potentes para replantearse y recuperar su capacidad de detectar problemas y buscar soluciones a los desafíos de nuestro tiempo.

ABSTRACT: To face up to the complexity of the contemporary world and to large scale problems, justice must be conceived in terms of risk. With the question of justice the law takes risks, and doing in this way it discovers new opportunities. Concepts like contrast, polarity, tension, dialogic, perturbation and difference are formal scheme that offers very promising and powerful instruments to recover its capacity to detect problems and to find solutions to the challenges our time.
