RESUMEN: Desde el primer día que empezamos el Grado en Economía, escuchamos hablar de monopolios, oligopolios, colusión en los mercados. De hecho es un tema que actualmente está muy a la orden del día en cuanto a debate social se refiere. Se habla mucho de que empresas propiedad del Estado, monopolios naturales, desigualdad entre productores y consumidores, pero es difícil controlar estas empresas: fomentar la eliminación de sus barreras de entrada, incentivación de otras empresas para entrar en el mercado y desarrollar la competencia.
Este ensayo tiene como objetivo enseñarnos un poco más acerca de las políticas de competencia, desde un punto de vista histórico del desarrollo de las leyes anti-trust y la necesidad de estas. La separación entre competencia y regulación. Entender que es un monopolio y por qué el poder de mercado provoca un descenso en el bienestar social, desde el punto de vista de la eficiencia asignativa y productiva.
De esta forma, analizando los casos de la Comisión Nacional de los Mercados y la Competencia, daremos una perspectiva práctica a los conceptos aprendidos, viendo ejemplos de abuso de poder por parte de grandes monopolios o de prácticas colusorias por parte de varias empresas que fijan precios o se reparten en mercado.
Aun acogiendo muchos de los sectores en los que hay competencia desleal (Energético, Telecomunicaciones, Sector Postal…), nos ajustaremos a los casos de a CNMC que se centran en el sector transporte, concretamente en sector aeroportuario y ferroviario por ser los que poseen los grandes monopolios, estando el transporte por carretera y marítimo mucho más liberalizado. Aun así examinaremos todos los casos, intentando agruparlos, dentro del sector transporte, en los cuales la CNMC ha combatido la competencia desleal o está en proceso de vigilancia por posibles indicios de prácticas anticompetitivas. Estas agrupaciones se forman a partir de las divisiones de los distintos sectores, clasificándolos así en sector aeroportuario, ferroviario, marítimo y otros, que está compuesto principalmente del transporte por carretera, tanto como si son de ámbito nacional o internacional, de transporte de mercancías o de pasajeros.
ABSTRACT: Since the first day we started the Economy Degree, we heard about monopolies, oligopolies and collusion in the markets. In fact, it’s a matter in which nowadays it is part of the daily agenda in the context of social debate. It is frequently discussed in enterprises which are property of the State, natural monopolies, and inequality between producers and consumers, but it is difficult to control this kind of Enterprises: foment the removal of the entry barriers, encourage the other enterprises to enter the market and develop the competition.
The aim of this essay is to show us a little more about the competition policies, from a historical point of view of the anti-trust law's development and the necessity of them. The break between competition and regulation. Besides, to understand the meaning of monopoly and why the significant market power causes a decrease in the social welfare, from an allocative and productive efficiency's point of view.
In this way, analysing the Comisión Nacional de los Mercados y la Competencia's subjects, we will give a practice perspective to the learned concepts, seeing examples of abusing of power on the part of the big monopolies or cartel 's agreements on the part of some enterprises which fix prices or share the market.
Even assuming the CNMC includes a lot of the sectors most susceptible to unfair competition (Energy, Telecommunications, Postal…) we will adjust to the CNMC's subjects which focus on Transport Sector, specifically in the airport and rail sector for being the owners of big monopolies, being on road transport and maritime sector more liberalized. Even so, we will examine every subject, trying to classify them into the sector of transportation, in which the CNMC has fought the unfair competition or they are in the course of being watched because of possible signs of anticompetitive practices. These groupings are from the divisions of different sectors, classifying them in airport, rail, maritime and other which is based mainly in road transport, even if it is national or international, good transport or passenger transport.
