El concepto de acoso laboral: especial referencia al concepto jurídico-penal

Abstract

RESUMEN: El llamado “acoso laboral” se trata de una figura muy compleja que ha sido considerada una realidad social muy grave, reclamando la necesidad de intervención jurídica para su revención y sanción. Su complejidad comienza ya en la propia definición. Los primeros intentos en torno a la elaboración de un concepto de acoso laboral se hicieron en el ámbito psicosocial, sirviendo como base para la elaboración de un concepto en el ámbito jurídico, primero en el ámbito jurídico-laboral. Los esfuerzos realizados en el ámbito psicosocial y jurídico-laboral han servido, a su vez, como base para la elaboración de un concepto penal, respetando los principios que rigen en este ámbito, por lo que existen algunas diferencias entre el concepto penal y laboral que cabe delimitar, siendo éste el objeto del presente trabajo.

ABSTRACT: The so-called ‘workplace harassment’ is a complex concept that has become a very serious social phenomenon, which makes legal action necessary in order to prevent it and apply sanctions. Its complexity starts with the definition itself. The first attempts at categorizing workplace harassment were made within a psychosocial area, and this provided the basis for a legal concept, initially in the field of labour law. The efforts made in the psychosocial and labour law areas have in turn provided the grounds for the creation of a penal concept observing the principles which apply in this field. As a consequence there are some differences between the penal concept and the labour one which should be specified. That is the aim of this dissertation.
