Función parlamentaria y potestad disciplinaria: sanciones y procedimiento

Abstract

RESUMEN: El artículo analiza la adaptación del Estatuto Básico del Empleado aprobado mediante Ley 7/2007, de 12 abril, al marco de la Administración parlamentaria. El artículo 4 de esta Ley permite que sean, tanto las Cortes Generales como cada Asamblea Legislativa de Comunidad Autónoma, las que decidan la adaptación de esta Ley a su ámbito. Así mismo, el artículo se centra principalmente en las sanciones y en el procedimiento sancionador, y siempre desde una doble vertiente: tanto la regulación que hace la Ley de 2007, como la regulación actual de las Administraciones parlamentarias. Así mismo, se explican algunos problemas que surgen en la regulación de esta materia, sobre todo lo relativo al principio non bis in ídem, la suspensión provisional o la admisión de la caducidad del procedimiento.

ABSTRACT: This article deals with the adaptation of the Basic Statute for Civil Servants adopted by law 7/2007, of April 12 to the framework of the parliamentary administration. Article 4 of this law allows them to be both the Spanish Parliament and the Legislative Assembly of each autonomous community that decide to adapt this law to their own scope. Likewise, the article focuses primarily on the sanctions and the disciplinary procedure, always from a double aspect: both the regulation established by the law of 2007, as well as the current regulation of the parliamentary administrations. Also it is discussed some problems in the regulation of this matter: especially concerning the principle non bis in ídem; the temporary suspension or the revocation of the admission procedure.
