Justicia y ejercicio del poder: la infamia y los «delitos de lujuria» en la cultura legal de la Castilla medieval

Abstract

RESUMEN. La producción teórica y la puesta en práctica del derecho medieval en Castilla con relación a los delitos contra la reputación social (fama) constituye un territorio fértil para conocer de cerca las relaciones existentes entre reglamentación jurídica y valores de la sociedad castellana medieval, así como el papel desempeñado por la justicia pública en la resolución de los conflictos en el seno de la sociedad urbana. El análisis de este tema se aborda desde dos ámbitos diferentes. De una parte, se expone la legislación sobre la fama y la infamia, que fue promulgada en la Corona de Castilla durante la Edad Media. De otra, se analiza la manera en que fueron utilizados los tribunales para defender la fama o provocar la infamia de los acusados, a través del análisis de los delitos infamantes, como el adulterio y la sodomía, y cómo los tribunales se convirtieron en un ámbito de la lucha política de las elites urbanas.

ABSTRACT. The theoretical production and the putting in practice of the medieval right in Castile with relation to the crimes against the social reputation (fama) constitutes a fertile territory to know closely the relations between juridical regulation and values of the Castilian medieval society, as well as the role recovered by the public justice in the resolution of the conflicts in the bosom of the urban society. The analysis of this topic is necessary to approach it from two different areas. On one hand, we analyze the laws about fama and infamia, which was promulgated in the Crown of Castile during the Middle Ages. On other one, we analyze the way in which the courts were used to defend the reputation or to provoke the infamia of the defendants, across analysis of the shameful crimes, as the adultery and the sodomy, and the way in wich the courts become an area of the political struggle of the urban elites.
