La legítima como límite a la libertad de testar

Abstract

En el presente Trabajo de Fin de Máster acercamos al lector al sistema sucesorio español, centrándonos en la institución jurídica de la legítima y el principio jurídico de la libertad de testar, así como en la relación existente entre ambos. El trabajo recorre los aspectos más relevantes del sistema de legítimas de derecho común, complementando la exposición de los textos legales con citas doctrinales y jurisprudenciales. Concluimos con un análisis sobre el futuro de la institución en España, recogiendo cuáles son las críticas hacia dicha institución y los problemas que plantea en la actualidad. Además, ofrecemos nuestra propia tesis sobre una posible reforma del sistema sucesorio vigente en nuestro Estado.

In this Master´s Dissertation, we aim to familiarize the reader with the Spanish succession system, focusing specifically on providing an explanation of the legal institution of the legítima (compulsory share) and the legal principle of freedom of testation, as well as the relationship between both. The Master´s Dissertation addresses the most relevant aspects of the compulsory share system under Spanish civil law, complementing the presentation of the legal texts with doctrinal and case law references. It concludes with an analysis of the future of the compulsory share in Spain, outlining the criticisms directed at this institution and the issues it currently presents. Furthermore, the thesis puts forward our position regarding a possible reform of the existing succession system in the Spanish legal framework.
