La amnistia en el ordenamiento constitucional español

Abstract

Este trabajo titulado ``La amnistía en el ordenamiento constitucional español´´ tiene por objeto revisar la historia de la gracia desde la perspectiva de la amnistía e intentar esclarecer la compatibilidad de esta con la Constitución Española y el común del ordenamiento jurídico, desde el prisma del derecho constitucional, principalmente, buscando aclarar la incógnita de si una amnistía sería o no constitucional, además de valorar, por su importancia, la compatibilidad de la Ley Orgánica de Amnistía con las conclusiones de este trabajo. Para alcanzar este objetivo se han analizado los distintos cuerpos constitucional de la tradición jurídica española, la normativa vigente y la jurisprudencia relevante a la hora de acotar el contenido y los límites de la gracia

This article titled "Amnesty in the Spanish Constitutional Order" aims to review the history of grace from the perspective of amnesty and attempt to clarify its compatibility with the Spanish Constitution and the broader legal system, mainly conducted from the standpoint of constitutional law, with the goal of determining whether an amnesty would be constitutional or not. Additionally, the study evaluates, due to its significance, the compatibility of the Organic Law of Amnesty with the conclusions of this work. To achieve this aim, various constitutional bodies of the Spanish legal tradition, current regulations, and relevant case law have been analyzed in order to define the content and limits of grace
