Las tensiones en el mar de China Meridional

Abstract

El Arbitraje en el Mar de China Meridional de 2016 es el resultado de una creciente tensión regional como consecuencia de la reivindicación de derechos históricos sobre recursos vivos y no vivos por parte de China. El Tribunal se pronuncia a favor de Filipinas, pero la situación no se ve alterada de facto, al no reconocer China el laudo arbitral y carecer el Tribunal de poder ejecutivo. El interés de este pronunciamiento arbitral radica también en que trasciende el caso concreto, al abordar cuestiones generales de interpretación y aplicación de disposiciones de la CONVEMAR relativas al arreglo de controversias y a la regulación de algunos espacios marinos, incidiendo de manera importante en el desarrollo del Derecho Internacional del Mar

The 2016 South China Sea Arbitration is the result of growing regional tension stemming from China's claim to historical rights over living and non-living resources. The Tribunal ruled in favor of the Philippines, but the situation remains unchanged de facto, as China does not recognize the arbitral award and the Tribunal lacks executive power. The significance of this arbitral award also lies in the fact that it transcends the specific case, addressing general issues of interpretation and application of UNCLOS provisions relating to dispute settlement and the regulation of certain marine areas, thereby having a significant impact on the development of international law of the sea
