La figura del agente encubierto: eficacia investigadora, control y límites

Abstract

El trabajo analiza la figura del agente encubierto como herramienta excepcional de investigación penal, con especial atención a su régimen jurídico en el ordenamiento español. En primer lugar, se estudia su concepto y naturaleza jurídica, diferenciándolo de figuras afines como el agente provocador, el confidente y el arrepentido. En segundo lugar, se examina el procedimiento de autorización judicial, el órgano competente para acordar la medida, su forma de adopción y los límites temporales de la infiltración. Por último, se abordan los límites y garantías que deben regir la actuación del agente encubierto durante el desarrollo de la operación, así como el valor probatorio de las pruebas obtenidas. This paper analyzes the figure of the undercover agent as an exceptional tool in criminal investigations, with special attention to its legal regime within the Spanish legal system. Firstly, it explores the agent’s concept and legal nature, distinguishing it from related figures such as the agent provocateur, the informant, and the repentant offender. Secondly, it examines the procedure for judicial authorization, the competent authority to approve the measure, the manner of its adoption, and the temporal limits of infiltration. Finally, it addresses the limits and safeguards that should govern the agent’s conduct during the operation, as well as the evidentiary value of the information obtained. The study aims to provide a legal reflection on the challenges this figure presents in a state governed by the rule of law.
