La usucapión contra tabulas: análisis del artículo 36 de la ley hipotecaria

Abstract

En el sistema jurídico español, los derechos reales no solo pueden nacer al margen del Registro de la Propiedad, sino que también pueden desplegar efectos jurídicos sin necesidad de estar inscritos, ya que su inscripción tiene un carácter declarativo y voluntario. Por ello, la usucapión puede producirse fuera del ámbito registral, generando posibles discrepancias entre la realidad extrarregistral y la reflejada en el Registro. En este contexto se analiza el tratamiento que la legislación hipotecaria española otorga a la usucapión, en particular a través del artículo 36 de la Ley Hipotecaria que regula la usucapión contra tabulas, esto es, aquella que opera en contradicción con lo que el Registro publica, y en la que la prescripción misma es la causa de la inexactitud registral.

In the Spanish legal system, real rights may arise independently of the Land Registry and can produce legal effects even without being registered, since registration generally has a declarative and voluntary character. As a result, usucapion can take place outside the scope of the registry, potentially leading to discrepancies between the extraregistered legal reality and what is reflected in the official records. In this context, the present study examines the way Spanish mortgage legislation addresses usucapion, particularly through Article 36 of the Mortgage Law, which governs usucapion contra tabulas—that is, usucapion that operates in contradiction to the content of the Land Registry, and in which the prescriptive acquisition itself becomes the cause of the registral inaccuracy.
