El régimen jurídico del trabajador extranjero en España: análisis y evolución normativa

Abstract

El presente trabajo tiene por objeto analizar la situación en la que se encuentran los extranjeros que vienen a buscar una oportunidad laboral a España, con especial hincapié en la evolución normativa entre el Real Decreto 557/2011 y el Real Decreto 1155/2024 sobre derechos y libertades de los extranjeros en España y su integración social. A través de una comparativa legislativa y un estudio de la jurisprudencia más relevante, se pretende examinar los distintos cambios en materia de contratación que afectan a la inserción laboral de los extranjeros y sus implicaciones en el mercado de trabajo. Asimismo, se aborda la situación actual del trabajador extranjero que se encuentra ya en nuestro país, haciendo una diferencia entre los que están en situación regular e irregular y valorando los posibles desafíos a los que se enfrentan a la hora de acceder a un empleo.

This proyect aims to analyse the situation of foreigners who come to Spain to seek employment opportunities, with special emphasis on the regulatory developments between Royal Decree 557/2011 and Royal Decree 1155/2024 in the rights and freedoms of foreigners in Spain and their social integration. Through a legislative comparison and a study of the most relevant jurisprudence, the aim is to examine the different changes in hiring regulations that affect the labor integration of foreigners and their implications in the labour market. Likewise, the current situation of foreign workers who are already in our country is addressed, differentiating between those in a regular and irregular situation and assesing the posible challenges they face in accessing employment.
