Protección jurídica contra los deepfakes: análisis de la normativa actual y desafíos regulatorios

Abstract

Este trabajo tiene por objeto el análisis del estado regulatorio actual de los nuevos desafíos legales que suponen la Inteligencia Artificial y, particularmente, los deepfakes en el ámbito del derecho civil. Con este propósito evaluaré las principales normativas vigentes en este ámbito, haciendo hincapié en la situación actual en Europa y España y explorando las posibles direcciones a las que se puede encaminar la legislación en los próximos años. El auge de los deepfakes genera nuevos dilemas jurídicos debido a que su uso puede llevar a la vulneración de los derechos de privacidad, la estafa o la manipulación de la identidad. Bajo estas premisas se desarrolla el siguiente estudio, en el que primeramente se analizará la normativa europea para después tratar específicamente la situación regulatoria actual en España y las perspectivas en el futuro próximo

The aim of this paper is to analyze the current regulatory status of the new legal challenges posed by artificial intelligences and in particular deepfakes in the field of civil law. For this purpose, I will evaluate the main regulations in force in this field, emphasizing the current situation in Europe and Spain and exploring the possible directions in which the legislation may be heading in the coming years. The rise of deepfakes generates new legal dilemmas due to the fact that their use can lead to the violation of privacy rights, fraud, identity manipulation. Based on this assumptions, the study that follows will first deal with the European regulations and then specifically address the current regulatory situation in Spain and the prospects for the near future
