El presente trabajo tiene por objeto analizar del tratamiento jurídico del
terrorismo en la Unión Europea, centrándose especialmente en la Directiva 2017/541 de
15 de marzo de 2017 relativa a la lucha contra el terrorismo y al Reglamento 2021/784
de 29 de abril de 2021, sobre la lucha contra la difusión de contenidos terroristas en línea,
por ser dos de las normas fundamentales a través de las que se articula la lucha contra el
terrorismo y la prevención de la radicalización en la UE. A partir de una primera
aproximación al contexto en el que cada una de las normas fueron elaboradas, se
examinan los aspectos más relevantes de sus disposiciones haciendo referencia a su
aplicabilidad teniendo en cuenta las últimas tendencias sobre el uso recurrente de Internet
para el desarrollo de la actividad terrorista. Finalmente, dedico una parte sustancial del
estudio de las normas a exponer las críticas que se han suscitado y los problemas que han
surgido de la aplicación de estas normas, con especial énfasis en el impacto que estas han
podido tener en el ejercicio de los derechos fundamentales, particularmente el derecho a
la libertad de expresión e información por ser los más afectados por esta regulación.
The aim of this paper is to analyse the legal treatment of terrorism in the
European Union, focusing especially on Directive 2017/541 of 15 March 2017 on
combating terrorism and Regulation 2021/784 of 29 April 2021 on combating the
dissemination of terrorist content online, as they are two of the fundamental rules through
which the fight against terrorism and the prevention of radicalisation in the EU is
articulated. Starting with a first approach to the context in which each of the rules were
drafted, the most relevant aspects of their provisions are examined, with reference to their
applicability in the light of the latest trends in the recurrent use of the Internet for the
development of terrorist activity. Finally, a substantial part of the study of the norms is
devoted to exposing the criticisms that have arisen and the problems that have arisen from
the application of these norms, with special emphasis on the impact that they may have
had on the exercise of fundamental rights, particularly the right to freedom of expression
and information, which are the most affected by these regulations.
