El derecho de asilo

Abstract

A lo largo de la redacción de este trabajo se analizará el marco jurídico que rodea la institución del derecho de asilo. En primer lugar, se abordará la perspectiva europea, para seguidamente ver cómo se afronta esta cuestión en el ordenamiento jurídico español. Para ello, se estudiará la normativa más relevante de la Unión Europea sobre la protección internacional de este derecho. También se estudiará la doctrina y se verán sentencias que ejemplifiquen la forma en la que dicha normativa se aplica ante situaciones reales. A continuación, se aportará una definición de siguientes conceptos: seguridad, refugio, persecución. Por último, se acometerá qué se considera como principio de no devolución, viendo sus vertientes y los contextos en los que surge esta consideración, además del principio de no devolución como fundamento frente la expulsión o devolución de los refugiados.

Throughout this paper, we will analyze the legal framework surrounding the institution of the right to asylum. First, we will address the European perspective, and then we will look at how this issue is dealt with in the Spanish legal system. To this end, we will study the most relevant European Union regulations on the international protection of this right. We will also study the doctrine and look at rulings that illustrate how these regulations are applied in real situations. Next, we will provide a definition of the following concepts: security, refuge, and persecution. Finally, we will examine what is considered the principle of non-refoulement, looking at its different aspects and the contexts in which this consideration arises, as well as the principle of non-refoulement as a basis for the expulsion or return of refugees.
