Abstract

En los últimos años, el reconocimiento de los animales como seres dotados de sensibilidad ha impulsado un cambio progresivo en su tratamiento jurídico. Esta evolución responde a una creciente conciencia social que demanda una protección legal más efectiva frente al maltrato animal. El presente trabajo analiza la regulación penal vigente en España en materia de bienestar animal, prestando especial atención a la reciente Ley Orgánica 3/2023, de 28 de marzo, que reforma el Código Penal con el objetivo de ofrecer una respuesta más adecuada a las conductas lesivas contra los animales y consolidar su condición jurídica como seres sintientes

In recent years, the recognition of animals as sentient beings has led to a progressive change in their legal treatment. This evolution responds to a growing social awareness that demands more effective legal protection against animal abuse. This paper analyses the current penal regulation in Spain in the field of animal welfare, paying special attention to the recent Organic Law 3/2023, of 28 March, which reforms the Penal Code with the aim of offering a more adequate response to harmful conduct against animals and consolidating their legal status as sentient beings
