Breve aproximación al sobreendeudamiento de las personas físicas no empresarias

Abstract

En este trabajo se analiza el concepto de insolvencia y sobreendeudamiento en las personas físicas no empresarias. Asi como mostrar la importancia y eficacia del procedimiento concursal que sirve como método para gestionar las deudas y proteger tanto a deudores como acreedores. Para ello se pone en relieve la normativa vigente del Real Decreto Legislativo 1/2020, de 5 de mayo de 2020, de la Ley Concursal y la última reforma de 2022, por la Ley 16/2022, de 5 de septiembre, que modifica la Ley Concursal, introduciendo el mecanismo de segunda oportunidad. This writing analyzes the concept of insolvency and over-indebtedness in the non-business individuals. As well as showing the importance and effectiveness of the bankruptcy proceeding that serves as a method to manage debts and protect both debtors and creditors. For this purpose, this highlights the current regulations of Royal Legislative Decree 1/2020, of May 5, 2020, of insolvency Law and the last reform of 2022, by Law 16/2022, of September 5, which modifies the Insolvency Law, introducing the second chance mechanism.
