El presente trabajo analiza la figura del hipotecante no deudor, persona que constituye una hipoteca sobre su propio bien para garantizar la deuda de otro. Se examina su naturaleza jurídica, diferenciándola de la fianza, aunque comparte ciertos elementos, y se estudia el alcance de su responsabilidad, estrictamente limitada al bien hipotecado. Se abordan los derechos frente al deudor principal, señalando la ineficacia de algunas acciones propias del fiador, y frente al acreedor hipotecario, considerando beneficios de excusión, división y otras excepciones, así como la relación con otros garantes. Se analiza su participación en la ejecución hipotecaria y las limitaciones legales que enfrenta en este procedimiento. Finalmente, se examina su consideración como consumidor y la protección normativa aplicable, conforme la jurisprudencia española y europea. El trabajo destaca la complejidad de esta figura y la necesidad de garantizar seguridad jurídica y protección frente a la exposición patrimonial que implica gravar un bien propio en favor de terceros
This paper analyzes the figure of the non-debtor mortgagor, a person who constitutes a mortgage over their own property to guarantee the debt of another. Its legal nature is examined, distinguishing it from suretyship, although certain elements are shared, and the scope of its liability is analyzed, which is strictly limited to the mortgaged property. The rights of the non-debtor mortgagor with respect to the principal debtor are examined, noting the ineffectiveness of certain actions typical of a surety, as well as the rights with respect to the mortgagee, considering the benefits of excussion, contribution, and other defenses, together with the relationship with other guarantors. Its participation in foreclosure proceedings and the legal constraints it faces therein are also examined. Finally, its status as a consumer and the applicable legal protections are examined in accordance with Spanish and European case law. The study highlights the complexity of this figure and the need to ensure legal certainty and protection against the patrimonial risks arising from encumbering one’s own property in favor of third parties
