Técnicas de reproducción humana asistida e igualdad

Abstract

El objeto de esta tesis es investigar la afectación del derecho fundamental a la igualdad y a no sufrir discriminaciones, en sus diversas formas, en el contexto de las técnicas de reproducción humana asistida que, ofreciendo grandes posibilidades beneficiosas para procrear y para la creación de familias diversas, pueden con su ordenación impactar en aquel derecho fundamental, implicando al de la salud reproductiva y al de desarrollo personal. La indagación aboga por una regulación y utilización de tales técnicas que garantice como valor nuclear del derecho a la igualdad, evitando desigualdades presentes y futuras que conviertan en un privilegio la posibilidad de tener hijos o los discrimine.

The purpose of this thesis is to investigate the impact of the fundamental right to equality and to avoiding discrimination, in their various forms, with the context of assisted human reproductive technologies. Whilst these technologies do offer clear advantages for procreation and the creation of diverse families, their ordinance can also have implications to reproductive health and personal development. This investigation advocates for the regulation and use of human reproductive technologies which guarantee the rights to equality as core value, and thereby avoiding parenthood from becoming or being a priviledge which discriminates.
