La pervivencia clásica del censo de los ciudadanos romanos

Abstract

D'Ors no consideraba la grandeza de los clásicos por la infalibilidad de sus hallazgos sino por la audacia de su intento. De hecho, animaba a los nuevos estudiosos del derecho romano (o de cualquier ciencia) a tratar de superar a los maestros en puntos concretos que conocieran bien. Esto es lo que el autor hace con este texto en relación a la figura del censor que, según Mommsen habría desaparecido en el Imperio por incompatibilidad con la legislación imperial. Según el autor, en cambio, los datos del censo eran necesarios para otras funciones exigidas por la administración imperial. Su tesis es que lo que desaparece es el lustrum pero no el censo en su totalidad.

D'Ors did not consider the grandeur of the classics for the infallibility of their findings but for the audacity of their attempt. In fact, he encouraged new scholars on Roman law (or any science) to try to outdo the Masters at specific points they knew well. This is what the author does with this text in relation to the figure of the censor that, according to Buckland would have disappeared in the Empire because of incompatibility with the imperial legislation. On the contrary, the author, sustains that census data were necessary for other functions required by the imperial administration. His thesis is that what disappeared is lustrum but not the census in its totality.
