Concurso de acreedores: caso Real Racing Club de Santander

Abstract

Este trabajo trata de realizar un análisis del proceso concursal en que el Real Racing Club de Santander, SAD se vio inmerso durante la última década, resulta esencial para entender su contexto y las implicaciones financieras y legales que se desprenden del proceso la experiencia vivida con un tipo de sociedad muy particular, las Sociedades Anónimas Deportivas (SAD). Examinando el marco jurídico español desde la promulgación de la Ley 10/1990, de 15 de octubre, del Deporte y las disposiciones específicas relacionadas con las SAD hasta el estudio de la Ley 22/2003, de 9 de julio, Concursal, se ofrece una visión que nos ayuda a comprender el contexto legal que rodea nuestro caso. El análisis se adentra en las distintas etapas del concurso de acreedores, desde la declaración del inicio hasta los convenios acordados y las soluciones adoptadas, todo ello dentro de la situación específica relativa al Racing de Santander. Esta visión no solo nos permite una comprensión profunda de los desafíos inherentes a los clubes deportivos en situaciones de insolvencia financiera, sino que también proporciona un análisis enriquecedor de las complejidades legales y financieras que afectan a las SAD en el ámbito deportivo español. Este estudio, a partir del Racing de Santander, busca brindar valiosas lecciones y perspectivas esclarecedoras que puedan ser extrapoladas y aplicadas a otros clubes deportivos que se enfrenten a circunstancias similares. De este modo, se presenta como una herramienta fundamental para quienes están involucrados en la gestión y administración de clubes deportivos, proporcionando un marco de referencia sólido y práctico en un entorno normativo y económico propenso al cambio constante. En conclusión, el trabajo aspira a ofrecer un análisis completo y en profundidad del impacto que supone para las instituciones deportivas el concurso de acreedores, enfocando el caso del Racing de Santander como un estudio de caso representativo

This project attempts to carry out an analysis of the bankruptcy process in which the Real Racing Club de Santander, SAD was immersed during the last decade, being essential to understand its context and the financial and legal implications that arise from the process the experience lived with a very particular type of company, Sports Joint Stock Companies (SAD). Examining the Spanish legal framework from the enactment of Sports Law 10/1990 and the specific provisions related to SAD to the study of Bankruptcy Law 22/2003, a vision is offered that helps us understand the legal context surrounding our case. The analysis delves into the different stages of the bankruptcy proceedings, from the declaration of initiation to the agreements agreed upon, and the solutions adopted, all within the specific situation relating to Racing de Santander. This vision not only allows us a Deep understanding of the challenges inherent to sports clubs in situations of financial insolvency, but also provides an enriching analysis of the legal and financial complexities that affect SAD in the Spanish sports field. This study, based on Racing de Santander, seeks to provide valuable lessons and clarifying perspectives that can be extrapolated and applied to other sports clubs facing similar circumstances. In this way, it is presented as a fundamental tool for those involved in the management and administration of sports clubs, providing a solid and practical framework of reference in a regulatory and economic environment prone to constant change. In conclusion, the project aims to offer a complete and in-depth analysis of the impact that bankruptcy has on sports institutions, focusing on the case of Racing de Santander as a representative case study. Using a multidisciplinary approach, it seeks to understand and contextualize the legal, financial and organizational complexities associated with the management of a sports institution in times of financial crisis
