El derecho a la identidad y a la correcta identificación del recién nacido

Abstract

Este trabajo tiene como objetivo examinar, desde un enfoque jurídico, el derecho a la identidad. Un derecho que ha ido evolucionando a lo largo del tiempo, y que comprende el derecho a un nombre y apellidos, fecha de nacimiento y nacionalidad. Este derecho supone la posibilidad de conocer los orígenes biológicos y de ser identificado y diferenciado de los demás. Se estudiará también el derecho de los adoptados a conocer sus orígenes biológicos, prestando especial atención a la figura de la adopción abierta, así como a los nacidos mediante técnicas de reproducción humana asistida. Y, por último, se analizará la correcta identificación y se evaluará los distintos métodos de identificación utilizados para tal fin, así como el papel tanto a nivel estatal como autonómico en relación a la identificación del recién nacido.

This project aims to examine, from a legal approach, the right to identity. A right that has evolved over time, and that includes the right to a name and surname, date of birth and nationality. This implies the possibility of knowing one's biological origins and of being identified and differentiated from others. The right of those adopted to know their biological origins will also be studied, paying special attention to the figure of open adoption, as well as those born through assisted human reproduction techniques. Finally, also correct identification will be analyzed, and the different identification methods used for this purpose will be evaluated, as well as the role at both the state and regional levels in relation to the identification of the newborn.
