El procedimiento de habeas corpus

Abstract

En este estudio, se analizará por medio de la recopilación de doctrina, jurisprudencia y valoraciones de distintos autores, el Procedimiento de Habeas Corpus. Este se trata de una garantía procesal, que recae fundamentalmente en uno de los valores superiores del Ordenamiento Jurídico español, como es el derecho a la libertad, recogido en el artículo 17 de la Constitución española. Por medio de nuestro análisis, podremos examinar la evolución de este Procedimiento a lo largo de la historia, principalmente en nuestro país y, además, la importancia de esta institución en nuestra sociedad actual

In this study, the Writ Habeas Corpus will be analyzed through the compilation of doctrine, jurisprudence and evaluations of different authors. This is a procedural guarantee, which falls fundamentally on one of the highest values of the Spanish legal system, such as the right to liberty, enshrined in Article 17 of the Spanish Constitution. Through our analysis, we will be able to examine the evolution of this Procedure throughout history, mainly in our country, and also the importance of this institution in our current society
