La doble maternidad y la determinación de la filiación en parejas homosexuales de mujeres derivada del uso de técnicas de reproducción humana asistida

Abstract

El presente trabajo trata la figura de la doble maternidad analizando el alcance que ésta está teniendo gracias a la introducción del apartado 3º en el art. 7 de la Ley 14/2006, de 26 de mayo, sobre técnicas de reproducción humana asistida. Esto ha supuesto una gran evolución en materia de filiación, así como en la posibilidad de atribución a las parejas homosexuales de mujeres de la filiación de los hijos de su esposa o compañera sentimental. En este ámbito varias resoluciones judiciales han sido precedentes y claves, arrojando importantísima jurisprudencia sobre el tema, destacando en el trabajo la STS de 5 de diciembre de 2013, la STS de 15 de enero de 2014 y la STS de 27 de enero de 2022. No obstante, todavía siguen existiendo diferencias en el régimen jurídico en materia de filiación y TRHA entre los matrimonios heterosexuales y los formados por personas del mismo sexo

This work deals with the figure of double maternity by analyzing the reach it is having thanks to the introduction of section 3 in the art. 7 of the Law 14/2006 on assisted human reproduction techniques. This has released a great evolution in matters of filiation as well as in the possibility of attributing to homosexual couples of women the filiation of the children of their wife or sentimental partner. In this field several judicial resolutions have been precedents and key, providing very important jurisprudence on the subject, highlighting in the work the sts of December 5, 2013, the sts of January 15, 2014 and the sts of January 27, 2022.
