El 25 de junio de 2021 entró en vigor en España la Ley Orgánica 3/2021, de 24 de marzo, de regulación de la eutanasia, una controvertida ley que da respuesta a una demanda social como es la decisión de un sujeto de acabar con su propia vida a través de la solicitud de una ayuda para morir.
En el presente documento realizaré un estudio en profundidad de la ya mencionada ley, así como de los conceptos relevantes y cuestiones éticas desde un punto de vista histórico y evolutivo. Mi objetivo no es otro sino conseguir que el lector sufra una inmersión en dicho tema y consiga entender las dificultades que conlleva la aprobación de esta ley, además de analizar el fundamento empleado por el poder legislativo para conseguir regular un derecho que aparentemente atenta contra un bien jurídico protegido constitucionalmente como es el derecho a la vida.
A continuación, tocaremos temas tan diversos como el propio concepto de eutanasia, el procedimiento para solicitarla o las sentencias del TC que amparan la legalidad de dicha ley
On June 25, 2021, Organic Law 3/2021, of March 24, on the regulation of euthanasia, came into force in Spain, a controversial law that responds to a social demand such as the decision of a subject to end his or her own life through the request for assistance in dying.
In this document I will carry out an in-depth study of the aforementioned law, as well as the relevant concepts and ethical issues from a historical and evolutionary point of view. My objective is none other than to immerse the reader in this subject and to understand the difficulties involved in the approval of this law, in addition to analyzing the basis used by the legislative power to regulate a right that apparently threatens a constitutionally protected legal right such as the right to life.
Next, we will touch on topics as diverse as the concept of euthanasia itself, the procedure for requesting it or the rulings of the Constitutional Court that protect the legality of this law
