Este trabajo de fin de grado aborda la rectificación registral de la mención relativa al sexo, centrándose en el marco legislativo y las implicaciones sociales y jurídicas de este proceso. Se realiza una exploración profunda del concepto de transexualidad, diferenciando entre sexo y género, y se analiza la evolución de la transexualidad hacia el reconocimiento de la disforia de género.
El estudio revisa los antecedentes normativos, incluyendo la Ley 3/2007 y la Instrucción de 2018, que regulaban el cambio de nombre y la rectificación del sexo en el registro civil para personas transexuales. También se analiza la sentencia del Tribunal Constitucional 99/2019, que influyó significativamente en la interpretación y aplicación de estas normativas.
Con la promulgación de la Ley 4/2023, se establece un nuevo marco legal para la igualdad real y efectiva de las personas trans y la garantía de los derechos de las personas LGTBI. Esta ley introduce cambios significativos en los procedimientos de rectificación registral, define las personas legitimadas para solicitarla, los efectos del cambio, y la adecuación de documentos oficiales.
Finalmente, el trabajo identifica y discute las dificultades y desafíos que plantea la nueva ley. Este análisis ofrece una visión comprensiva de los avances y retos en la legislación sobre la rectificación de la mención relativa al sexo, reflejando el constante progreso hacia la igualdad y el reconocimiento de la identidad de género
This undergraduate thesis addresses the registry rectification of the mention related to sex, focusing on the legislative framework and the social and legal implications of this process. It provides an in-depth exploration of the concept of transsexuality, differentiating between sex and gender, and analyzes the evolution of transsexuality
towards the recognition of gender dysphoria.
The study reviews the normative background, including Law 3/2007 and the 2018 Instruction, which regulated name changes and sex rectification in the civil registry for transsexual people. It also examines Constitutional Court ruling 99/2019, which significantly influenced the interpretation and application of these regulations.
With the enactment of Law 4/2023, a new legal framework is established for the real and effective equality of trans people and the guarantee of LGTBI rights. This law introduces significant changes in registry rectification procedures, defines the individuals entitled to request it, the effects of the change, and the adjustment of official documents.
Finally, the thesis identifies and discusses the difficulties and challenges posed by the new law. This analysis provides a comprehensive view of the advances and challenges in legislation on the rectification of the mention of sex, reflecting the ongoing progress towards equality and the recognition of gender identity
