La desheredación en el derecho español: evolución jurisprudencial y adaptación a las realidades sociales

Abstract

El Código Civil español, en la regulación de la sucesión, incluye una reserva de bienes en favor de determinados familiares, llamada legítima. Pero también permite, siempre que se den determinadas causas, privar a estos herederos forzosos de dichos bienes. La regulación de la desheredación ha sido objeto de debate en las últimas décadas por no saber adaptarse a la nueva realidad social. Pese a los esfuerzos de la jurisprudencia, la falta de evolución legislativa ha provocado que el sistema deje de proteger aquellos intereses para los que se creó en un primer momento. De ahí que una gran parte de la doctrina considere urgente una actualización que aporte seguridad jurídica y adapte el sistema de sucesiones al nuevo contexto social

The Spanish Civil Code, in its regulation of succession, includes a mandatory share of the estate for certain family members, known as the "legítima". However, it also allows for these forced heirs to be disinherited under certain conditions. The rules concerning disinheritance have been a subject of debate in recent decades, as they have not adapted to the new social reality. Despite the efforts of the judiciary, the lack of legislative evolution has resulted in the system no longer protecting the interests for which it was originally created. Consequently, a significant portion of legal scholars consider it urgent to update the system to provide legal certainty and adapt the succession laws to the new social context
