El aborto en papel o aborto masculino: ¿Un nuevo derecho o una nueva forma de opresión?

Abstract

El núcleo de este trabajo es la figura del aborto masculino o aborto en papel, la cual cuestiona si, en el caso de un embarazo no deseado, los hombres deberían ser obligados a ser padres y por ello a pagar la manutención de los hijos, aunque no quisieran. Para poder comprender este nuevo concepto, lo analizaremos desde el punto de vista de quienes lo defienden y consideran como un derecho necesario para los hombres, como desde el punto de vista de quienes lo critican, pues consideran que puede utilizarse como herramienta de presión a las mujeres para que aborten. A través de dicho análisis, podremos discernir si este concepto nos acerca o nos aleja del objetivo de conseguir una sociedad lo más igualitaria posible, adentrándonos de lleno en el debate generado por este nuevo concepto, sobre la necesidad de equiparación de derechos reproductivos entre hombres y mujeres. Además, exploraremos este concepto desde su origen, a finales del siglo pasado, hasta su reciente debate en auge, especialmente en países como Dinamarca o Suecia, y lo haremos desde un punto de vista jurídico, económico y social. Por último, procuraremos realizar una hipotética regulación legal del aborto en papel en el sistema jurídico español, tratando de dar solución a las situaciones que se presenten

The core of this paper is the concept of male abortion or abortion on paper, which questions, in the case of an unwanted pregnancy, whether men should be forced to be fathers and therefore to pay child support, even if they do not want to be fathers. In order to understand this new concept, we will analyze it from the point of view of those who defend it and consider this concept as a necessary right for men, as well as from the point of view of those who criticize it, because they consider that this concept can be used as a tool to pressure women to have abortions. Through this analysis, we will be able to discern whether this concept brings us closer or further away from achieving a society as egalitarian as possible, entering into the debate about the need for equal reproductive rights between men and women. In addition, we will explore this concept from its origin, at the end of the last century, to its recent growing debate, especially in countries such as Denmark or Sweden, and we will do so from a legal, economic and social point of view. Finally, we will try to carry out a hypothetical legal regulation of abortion on paper in the Spanish legal system, trying to provide a solution to the different situations that may arise
