Una aproximación a los neuroderechos como nueva categoría jurídica

Abstract

Este trabajo se enfoca en abordar una nueva posible gama de derechos humanos fundamentales, que surgen como impacto del creciente desarrollo de neurotecnologías. Trata de conceptualizar y situar la problemática mediante un primer enfoque sobre que son las neurotecnologías y cómo han evolucionado las tecnologías, en general, hasta este punto, pasando al tema principal que son los neuroderechos en los que se desarrollan los cinco tipos que se plantean y, además, se menciona una serie de principios éticos que van ligados con los neuroderechos y, finalmente, el trabajo acaba con una reflexión personal sobre la necesidad de los neuroderechos y de si se trata efectivamente de una nueva gama de derechos humanos o, sin embargo, se trata de una modulación de los derechos existentes a una nueva realidad social afectada por nuevas neurotecnologías

This work focuses on addressing a new possible range of fundamental human rights, which arise as an impact of the growing development of neurotechnologies. It tries to conceptualize and situate the problem through a first approach to what neurotechnologies are and how technologies have evolved, in general, to this point, moving to the main theme that is neurorights in which the five types that are raised are developed and, in addition, a series of ethical principles that are linked to neurorights are mentioned and, finally, the work ends with a personal reflection on the need for neurorights and whether it is effectively a new range of human rights or, nevertheless, it is a modulation of rights Existing to a new social reality affected by new neurotechnologies
