Resumen/Abstract
The purpose of the present work is nothing more than to reflect in the following lines the foundations for a consolidated legislative critique. The new techniques of reproduction are a reality that has come to stay and, therefore, require a regulation in constant evolution and updating parallel to technical-scientific advances. Maintaining archaic institutions implies, tacitly, turning a blind eye and simulating a reality that is not present. Likewise, legislative immobility inevitably brings with it the need to fill gaps, forcing the courts to legislate, thereby breaking one of the fundamental principles in a democratic state, the separation of powers
