Lo legal y lo legítimo: notas en torno a la relación entre Otto Kirchheimer y Carl Schmitt

Abstract

El presente trabajo pretende analizar la categoría de legitimidad constitucional a partir del debate mantenido entre Otto Kirchheimer y Carl Schmitt, discípulo y maestro durante la República de Weimar. Dicho debate nos permitirá, además, presentar la biografía intelectual y, sobre todo, la teoría del Estado y de la Constitución del joven Otto Kirchheimer, parcialmente olvidada, al público español. En el contexto de este análisis, consideramos interesante abordar igualmente la influencia de Carl Schmitt en la izquierda académica desde un punto de vista histórico y contemporáneo, teniendo en cuenta las contradicciones metodológicas del propio Kirchheimer, primer representante de lo que viene considerándose como "izquierda schmittiana".

This paper aims to analyze the category of constitucional legitimacy from the debate held between Otto Kirchheimer and Carl Schmitt, student and teacher during the Republic of Weimar. This debate will also allow us to present the intellectual biography and, above all, the theory of the State and the Constitution of the young Otto Kirchheimer, partially forgotten, to the Spanish public. In the context of this analysis, we consider interesting to address Carl Schmitt´s influence on the historical and contemporary academic left, taking into account the methodological contradictions of Kirchheimer himself, the first representative of what has been considered as "Left-Schmittianism".
