Política ambiental de Cantabria 2022: la nueva ley del suelo de Cantabria, la anulación judicial del PORN de las marismas de Santoña, Noja y Joyel y del puerto de San Vicente de la Barquera

Abstract

La actividad normativa ha venido protagonizada este año 2022 por la aprobación de una nueva ley reguladora del urbanismo y la ordenación del territorio que deroga a la Ley 2/2001: la Ley 5/2022, de 15 de junio, de Ordenación del Territorio y Urbanismo de Cantabria. No es una Ley totalmente rompedora, pero sí que incorpora algunas novedades relevantes que inciden en aspectos relacionados con el medio ambiente. En cuanto a los conflictos más relevantes, continúa el malestar del Gobierno por la protección del Lobo al norte del río Duero que, de hecho, ha intentado sin éxito autorizar la caza de algunos ejemplares. Continúa lentamente también la tramitación para la implantación de parques eólicos que, si bien en el año 2022 no han culminado, está generando en los grupos vecinales afectados una importante contestación. Por último se han dictados dos Sentencias importantes por la Sala de lo contencioso-administrativo del TSJ de Cantabria que afectan a dos espacios naturales protegidos: las Marismas de Santoña, Noja y Joyel (se anula el PORN) y el Parque Natural de Oyambre (se ha anulado un proyecto de puerto deportivo en ese espacio).

This year, 2022, the main regulatory activity has been the approval of a new law regulating urban and regional planning, which repeals Law 2/2001: Law 5/2022, of June 15, on Spatial Planning and Urban Development of Cantabria. It is not a totally groundbreaking Law, but it does incorporate some relevant novelties that affect aspects related to the environment. With regard to the most relevant conflicts, the Government continues to feel uneasy about the protection of the wolf north of the Duero river, and has tried unsuccessfully to authorize the hunting of some specimens. The process for the implementation of wind farms continues slowly and, although it has not been completed by the year 2022, it is generating significant opposition from the affected neighborhood groups. Finally, two important rulings have been handed down by the Contentious-Administrative Chamber of the Supreme Court of Cantabria affecting two protected natural areas: the Santoña, Noja and Joyel Marshes (the PORN is annulled) and the Oyambre Natural Park (a marina project in this area has been annulled).
