Una ley integral para la igualdad de trato y una ley orgánica para la igualdad entre mujeres y hombres: ¿Concurrencia o necesidad?

Abstract

No es una ley más. Es una ley que completa, añade, aclara y refuerza. Sí, el derecho a la igualdad de trato y a la no discriminación, aun cuando ya estuvieran garantizados constitucionalmente y desarrollados normativamente. Pero hay dos avances interesantes en el nuevo planteamiento del legislador. Uno, el interés por compendiar en una misma norma todos los elementos necesarios para alcanzar una tutela efectiva del derecho; y, dos, la necesidad de reconocer un derecho antidiscriminatorio configurado por una jurisprudencia constitucional ya consolidada y por avances sociales que obligan a modernizar conceptos que no han quedado obsoletos pero que se han demostrado insuficientes para regir la convivencia social.
