Los juicios paralelos y el principio de publicidad

Abstract

La globalización de la información, así como la contraposición de fines que caracteriza la relación entre la Administración de Justicia y los medios de comunicación provocan daños irreparables en los derechos y garantías de las partes que intervienen en los procesos judiciales. Por esta razón, en el presente trabajo se abordará el fenómeno de los juicios paralelos, con el objetivo de examinar los principales obstáculos que se generan en la transmisión y difusión de las noticias judiciales, así, se establecerá un concepto, se analizará el principio de publicidad que caracteriza el sistema judicial español y se examinará cómo el legislador ha respondido ante las dificultades que se presentan realizando, una breve aproximación a la figura británica del Contempt of Court.

The globalization of information, as well as the clash of purposes that characterizes the relationship between the Administration of Justice and the media, cause irreparable damage to the rights and guarantees of the parties involved in judicial proceedings. For this reason, this paper will address the phenomenon of parallel trials, with the aim of examining the main obstacles that are generated in the transmission and dissemination of judicial news, thus, a concept will be established, the principle of publicity that characterizes the Spanish judicial system will be analyzed and it will be examined how the legislator has responded to the difficulties that arise, making a brief approximation to the British figure of the Contempt of Court.
