El presente Trabajo de Fin de Grado nace con el objetivo de saber en qué medida España cumple con las obligaciones que se derivan del artículo 6 CEDH. Para ello, debemos saber que esta disposición reconoce el derecho fundamental a un proceso equitativo y que constituye un instrumento indispensable dentro del sistema jurídico del Convenio. Para llevar a cabo esta función, se establecen una serie de derechos y garantías individuales, que se engloban dentro del derecho general del artículo 6. Así encontramos, el derecho de acceso a un tribunal y a un proceso equitativo (art. 6.1 CEDH), el derecho a la presunción de inocencia (art. 6.2 CEDH) y los derechos de defensa (art. 6.3 CEDH). Como derecho fundamental que se trata, el Estado que ratifique el Convenio ha de cumplir lo dispuesto en el mismo. Para poder conocer si cumple con las obligaciones del mencionado artículo, analizaremos la jurisprudencia que ha involucrado a España en relación con este derecho, más destacable de los diez últimos años, dictada por el TEDH
This Final Degree Project was created with the aim of finding out to what extent Spain complies with the obligations derived from article 6 ECHR. To do so, we must know that this provision recognises the fundamental right to a fair trial, and that it constitutes an indispensable instrument within the legal system of the Convention. To carry out this function, a series of individual rights and guarantees are established within the general right of Article 6. Thus, we find the right of access to a court and to a fair trial (Art. 6.1 ECHR), the right to the presumption of innocence (Art. 6.2 ECHR) and the rights of defence (Art. 6.3 ECHR). As a fundamental right, a State ratifying the Convention must comply with its provisions. In order to find out whether it complies with the obligations of the aforementioned article, we will analyse the most notable case law, which has involved Spain in relation to this right, within the last ten years, handed down by the ECTHR.
