La influencia de las nuevas tecnologías en el derecho de huelga

Abstract

El presente trabajo se centra en el estudio del impacto que tienen las nuevas tecnologías en el ejercicio del derecho de huelga, haciendo especial mención al esquirolaje tecnológico. A estos efectos, se realiza un análisis exhaustivo y pormenorizado de la sustitución de los trabajadores huelguistas por medios tecnológicos en los procesos de huelga, incluyendo el estudio de su regulación jurídica y de la relevante evolución de la interpretación jurisprudencial sobre la materia a lo largo de los años, a los efectos de formular conclusiones sobre la necesidad de introducir un régimen jurídico que permita garantizar el derecho de huelga frente a los efectos de las nuevas tecnologías en el ámbito laboral.

This paper focuses on the study of the impact that new technologies have on the exercise of the right to strike, making special mention of technological scabbing. For these purposes, an exhaustive and detailed analysis of the substitution of striking workers by technological means in strike processes is carried out, including the study of its legal regulation and the relevant evolution of the jurisprudential interpretation on the matter over the years, in order to formulate conclusions on the need to introduce a legal regime that allows guaranteeing the right to strike against the effects of new technologies in the workplace.
