La constitucionalidad de la prisión permanente revisable

Abstract

En el año 2015, con la reforma del Código penal operada por la Ley Orgánica 1/2015, de 30 de marzo, se introduce en nuestro país una nueva pena: la prisión permanente revisable. Esta incorporación ha supuesto una gran controversia, desde el punto de vista jurídico así como también social, generando dos posturas sobre la misma, defensores y detractores en busca de su derogación, basando su argumentación en su incompatibilidad con los derechos, principios y valores que proclama nuestra Constitución propios del Estado de Derecho. El Tribunal Constitucional puso fin a este debate en la sentencia núm. 169/2021, de 6 de octubre, proclamando su constitucionalidad. El presente trabajo, bajo el máximo respeto a nuestro Tribunal, va a tratar de vislumbrar si esta pena realmente tiene encaje en nuestro marco constitucional y, en todo caso, si resulta conveniente.

In 2015, the reform of the Criminal Code operated by the Organic Law 1/2015, of 30 March, introduced a new type of prison sentence in our country: the reviewable permanent prison. This incorporation lead to a great controversy, from the legal as well as social point of view, generating two stances in regards to it, defenders who supported it and detractors who seeked its repeal, basing their position on its incompatibility with the rights, principles and values that our Constitution proclaims as part of the Rule of Law. The Constitutional Court ended this debate with the Sentence No. 169/2021 of 6 October, proclaiming its constitutionality. The present work, with the utmost respect to our Constitutional Court, will attempt to determine whether this penalty really fits into our constitutional framework and, above all, if it is convenient.
