El presente trabajo pretende fundamentar una cuestión que viene siendo debatida desde hace años entre la doctrina, esto es, la necesidad de modificar el sistema legitimario inserto en nuestro Código Civil. A lo largo del mismo, se expondrá la regulación actual, así como, los diferentes cambios sociales y económicos acaecidos durante los últimos tiempos, poniendo de manifiesto la relación existente entre el pensamiento propio de la sociedad y la visión crítica adoptada ante la institución. Se citarán las diferentes opiniones y razonamientos que predominan entre la doctrina de especial relevancia, para justificar la necesidad de un cambio legitimario, teniendo presente los diferentes sistemas propios del Derecho Foral y Comparado, los cuales servirán como precedente en la elaboración de una propuesta de cambio óptima para nuestro modelo legitimario.
The present work intends to put the bases on an issue that has been argued for years among the doctrine, this is, the need to modify the Legitimate System inserted in our Civil Code. Throughout it, the current regulation will be exposed, as well as the different social and economic changes that have happened recently, highlighting the relationship between the current thinking of society, and the critical vision adopted against the institution. The different opinions and reasonings that predominate among the doctrine of special relevance will be exposed, to justify the need for a change in the institution of the Legitimate, taking into account the different systems that prevail in Foral and Comparative Law, which will be mentioned as a precedent in the elaboration of an optimal change proposal in our Legitimate model.
