La imposición de las instituciones informales en la sociedad

Abstract

Este trabajo propone un análisis de la figura de las instituciones informales, teniendo en cuenta su posición dentro de la sociedad, que aún emanando de la autonomía privada y no del propio Estado juegan un papel importante en el entorno. Su finalidad es comprender estos sistemas informales a través del análisis de la literatura que ha abordado el tema hasta ahora, conocer sus posibles orígenes, las razones de su estabilidad en el tiempo y los efectos producidos por las interacciones con las propias normas jurídicas. Teniendo lo informal normalmente una connotación negativa, también pueden aportar flexibilidad y efectos positivos en la sociedad. Se profundizará en el estudio de casos típicos, como el clientelismo político o la mafia italiana, para obtener una visión empírica del fenómeno. Finalmente, todo ello se vinculará con el factor de la cultura de la legalidad de los sujetos inmersos en el fenómeno.

This paper proposes an analysis of the figure of informal institutions, taking into account their position within society, which even though they emanate from private autonomy and not from the State itself, they play an important role in the environment. The aim is to understand this informal system through an analysis of the literature on the subject so far, to understand its possible origins, the reasons for its stability over time and the effects produced by the interactions with the legal norms themselves. While the informal normally has a negative connotation, it also brings flexibility and positive effects on society, which will be detailed. Case studies such as political clientelism or the Italian mafia will be studied in depth in order to obtain an empirical vision of the phenomenon. Finally, all of this will be linked to the factor of the culture of legality of the subjects immersed in the phenomenon.
