El concepto de intimidación ambiental en el derecho penal

Abstract

Los delitos contra la libertad sexual han sido objeto de mucho análisis, críticas y reformas recientemente. El derecho, una vez más en su labor de adaptarse a las necesidades sociales, a los contextos morales, ideológicos, ha introducido varias modificaciones en esta clase de delitos con el objetivo de proteger y garantizar los derechos de las víctimas, reformas muy controversiales, como veremos, sobre todo en su puesta en práctica. Además, los casos que han llegado a los tribunales en los últimos años, algunos de ellos muy mediáticos, han propiciado una gran labor jurisprudencial en la interpretación del concepto jurídico indeterminado de intimidación, creando el concepto de intimidación ambiental, el cual ha resultado determinante en casos en los que el agresor o agresores se han valido de factores externos para generar un ambiente intimidatorio y así doblegar la voluntad de la víctima. A través de este trabajo, analizaremos las cuestiones más relevantes de la intimidación ambiental en el derecho penal.

Through this work, we will analyze the most relevant issues of environmental intimidation in criminal law.
