La gestación subrogada

Abstract

La gestación subrogada es una técnica de reproducción humana asistida cada vez más habitual en España. En el trabajo se analizan las leyes que lo regulan, así como los principales pronunciamientos jurisprudenciales en torno a determinar la filiación de los nacidos a través de esta práctica. En especial, la doctrina del Tribunal Supremo y los medios que proponen para determinar la filiación. Se estudian los supuestos de inscripción de menores nacidos en el extranjero por maternidad subrogada en el Registro Civil español. Se analizarán los principales derechos en juego de todas las partes. Por último, se propone una regulación que estudie esta problemática en profundidad.

Surrogacy is an increasingly common assisted human reproduction technique in Spain. In this project, the laws that regulate it are analyzed, as well as the main jurisprudential pronouncements around determining the filiation of those born through this practice. In particular, the doctrine of the Supreme Court and the means they propose to determine parentage. The cases of registration of minors born abroad by surrogate motherhood in the Spanish Civil Registry are studied also. The main rights at stake of all parties will be analyzed. Finally, a regulation is proposed that studies this problem in depth
