Análisis de un caso práctico relativo al despido del falso autónomo en la Administración Pública

Abstract

El falso autónomo en la Administración Pública es aquél que suscribe un contrato con una Administración, ya sea estatal, autonómica o local, con el objeto de prestar sus servicios para dicha Administración. Dicho servicio, en realidad, viene a ocultar una relación de naturaleza laboral, ya que en el desarrollo de dicho contrato administrativo, el "falso autónomo" actúa como si de un trabajador laboral se tratara. En este trabajo de carácter práctico, vamos a dar en primer lugar unos apuntes teóricos que nos ayuden a comprender en qué consiste esta figura, de modo que ante cualquier informe o documento ante el que nos encontremos sepamos diferenciar la existencia de dicha modalidad; y en segundo lugar vamos a proceder al análisis de un caso práctico relativo al despido de un trabajador por parte de una Administración, reuniendo éste los caracteres de la figura del “falso autónomo”.

The false self-employed person in the Public Administration is one who signs a contract with an Administration, whether state, regional or local, in order to provide their services for that Administration. That service, actually, comes to hide a relationship of a labor nature, since in the development of that administrative contract, the "false self-employed person" acts as if it were a labor worker. In this work of a practical nature, we are going to give, first of all, some theoretical notes that help us understand what this figure consists of so that in the face of any report or document that we find ourselves in, we know how to differentiate the existence of said modality; and secondly we are going to proceed to the analysis of a practical case related to the dismissal of a worker by an Administration, having this worker the characteristics of the figure of the "false self-employed person".
