Funcionarios habilitados de carácter estatal: régimen legal y el anteproyecto de ley de los pequeños municipios

Abstract

RESUMEN: Esta investigación tiene por objeto aportar una visión general de la figura de los Funcionarios Habilitados de Carácter Estatal y la problemática que existe en los municipios más pequeños. Este estudio está sustentado en la recopilación de la normativa, bibliografía, reflexiones y valoraciones que nos permitirá conocer y reflexionar acerca de este colectivo. Para conocer más a fondo la figura de estos funcionarios se comentará cómo fue su creación y los cambios y evolución que han sufrido hasta la actualidad. También se verá las diferentes clases de empleados que pueden existir en la administración pública, viendo el número de trabajadores existentes en las Corporaciones y realizando un análisis del número de FHCE con el resto de personal. Se explicará cómo se estructuran y las diferentes subescalas que existen, y los criterios de cada una y también la forma de acceder a los puestos de trabajo, bien sea por los procesos de selección o por la provisión de puestos de trabajo. Terminaré dicha investigación con los conflictos que existen con los municipios de menos habitantes y en general con los funcionarios habilitados y hare un análisis del Anteproyecto de Ley de Régimen de organización de los municipios de menor población, donde se explicará que incluye la normativa y que aspectos clave no aparecen en la norma.

ABSTRACT: The purpose of this research is to provide an overview of the figure of the Authorized Officials of a State Character and the problems that exist in the smallest municipalities. This study is supported by the compilation of regulations, bibliography, reflections and evaluations that will allow us to know and reflect on this group. To learn more about the figure of these officials, we will comment on how they were created and the changes and evolution they have undergone up to the present. The different classes of employees that may exist in the public administration will also be seen, seeing the number of existing workers in the Corporations and carrying out an analysis of the number of FHCE with the rest of the personnel. It will explain how they are structured and the different subscales that exist, and the criteria of each one and also the way to access jobs, either by selection processes or by the provision of jobs. I will finish this investigation with the conflicts that exist with the municipalities with fewer inhabitants and in general with the authorized officials and I will make an analysis of the Draft Law on the Organization Regime of the municipalities with less population, that is, that it includes the regulations and what aspects key do not appear in the standard.
