Suspensión del régimen de visitas o estancia del art. 94 del Código Civil tras su reforma por la Ley 8/2021, de 2 de junio

Abstract

La Ley 8/2021, de 2 de junio, ha modificado el apartado cuatro del art. 94 CC estableciendo la suspensión del régimen de visitas o estancia de los hijos con sus progenitores, cuando alguno de los últimos esté incurso en un procedimiento penal de violencia doméstica o de género o existan indicios de ello en atención a proteger al menor ante situaciones de violencia. Además, dicha norma encuentra reflejo en la normativa foral y, ambas, esto es, la normativa común y la foral, están a la espera de su juicio de constitucionalidad.

The Act 8/2021, 2nd June, has modified section four of art. 94 Civil Code establishing the suspension of parenting time of the children with their parents, when one of their parents is involved in a criminal procedure of domestic violence or gender violence or there are indications of it to protect the minor in situations of violence. In addition, said rule is reflected in the regional regulations and both, that is, the common and regional regulations, are awaiting their constitutionality trial.
