RESUMEN:Las prestaciones de muerte y supervivencia son el auxilio por defunción, la pensión vitalicia de viudedad, la prestación temporal de viudedad, la pensión de orfandad, la prestación de orfandad, las indemnizaciones a tanto alzado y las prestaciones a favor de familiares. En el presente trabajo se ha investigado en profundidad las prestaciones de muerte y supervivencia, haciendo hincapié tanto en la prestación como en la pensión de orfandad, analizando no solo la normativa pasada y presente al respecto, sino profundizando también en las diferentes decisiones tomadas por los Tribunales Superiores de Justicia así como el Tribunal Supremo, y en las opiniones que estas suscitan entre diferentes sectores de la doctrina, para terminar recabando las conclusiones a las que se han llegado tras realizar dicha investigación.
ABSTRACT: The death and survival benefits are the death benefit, the lifelong widow's pension, the temporary widow's benefit, the orphan's pension, the orphan's benefit, lump-sum compensation and benefits in favor of family members. In the present work, death and survival benefits have been investigated in depth, emphasizing both the benefit and the orphan's pension, analyzing not only the past and present regulations in this regard, but also delving into the different decisions made by the Superior Courts of Justice as well as the Supreme Court, and in the opinions that these provoke among different sectors of the doctrine, to finish collecting the conclusions that have been reached after carrying out said investigation.
