El procedimiento de Habeas Corpus

Abstract

RESUMEN: El objeto de este trabajo que está apunto de leer es aportar una visión general de una interesantísima institución procesal que presenta el Ordenamiento Jurídico español. El trabajo se sustenta en la recopilación metodológica y cualitativa de jurisprudencia, bibliografía, reflexiones y valoraciones de la doctrina que nos permitirá hacer reflexionar y valorar una institución jurídica en la actualidad. Abordaremos desde un estudio apasionado una institución histórica de protección y garantía de Derechos Fundamentales, los cuales, vienen recogidos en la Constitución Española en los artículos 14 al 29, siendo estos la prueba más palpable y por ello emblemática de la superioridad del Estado de Derecho. Nos centraremos en el artículo 17 de la Carta Magna, que prevé uno de los derechos más elementales, el derecho a la libertad.

ABSTRACT: The aim of this work that you are about to read is to provide an overview of a very interesting procedural institution in the Spanish legal system. The work is based on the methodological and qualitative compilation of jurisprudence, bibliography, reflections and evaluations of the doctrine that will allow us to reflect on and evaluate a legal institution in the present day. We will approach from a passionate study a historical institution of protection and guarantee of Fundamental Rights, which are included in the Spanish Constitution in articles 14 to 29, these being the most palpable and therefore emblematic proof of the superiority of the Rule of Law. We will focus on Article 17 of the Spanish Constitution which provides for one of the most basic rights, the right to freedom.
