Cuestiones jurídicas en torno a la ocupación ilegal de inmuebles

Abstract

RESUMEN: El presente trabajo constituye un estudio integral sucinto de la ocupación integral de inmuebles en España desde distintas ópticas jurídicas, como son el derecho constitucional, civil, penal y procesal. De esta manera, una vez que se aborda inicialmente en el capítulo I la evolución histórica del movimiento okupa, se pasa con posterioridad los aspectos de índole jurídica. Así las cosas, el capítulo II establece cuáles son los derechos constitucionales en juego, mientras que los capítulos III y IV suponen una aproximación del asunto desde la jurisdicción civil y penal.

ABSTRACT: The present work constitutes a succinct comprehensive study of the squatting in Spain from different legal perspectives, such as constitutional, civil, criminal and procedural law. In this way, once the historical evolution of the squatting movement is initially addressed in chapter I, the legal aspects are subsequently tackled. Thus, chapter II establishes which are the constitutional rights at stake, while chapters III and IV are an approximation of the matter from the civil and criminal jurisdiction.
