Competencia versus prevalencia: el pulso en el estado autonómico español

Abstract

RESUMEN: Una visión sobre la posición de la prevalencia como mecanismo de resolución de conflictos entre el Estado y las Comunidades Autónomas en una de las materias más sensibles que existen en nuestro sistema constitucional y político, el reparto de competencias. Vamos a entender cuales y son las principales líneas que nuestro constituyente esbozó para establecer nuestro complejo sistema de reparto de competencias, desde el sistema que en La República se estableció hasta el modelo actual haciendo mención a sistemas de derecho comparado. Nos daremos cuenta del mecanismo que nuestro Tribunal Constitucional ha utilizado y el momento en el cual ha decidido cambiar su criterio arrojando muchas dudas en un sistema sobre es que ya había algunas sombras.

ABSTRACT: A vision of the position of primacy as a mechanism for resolving conflicts between the State and the Autonomous Communities in one of the most sensitive matters that exist in our constitutional and political system, the distribution of powers. We are going to understand which and are the main lines that our constituent outlined to establish our complex system of distribution of powers, from the system that was established in La República to the current model, mentioning comparative law systems. We will realize the mechanism that our Constitutional Court has used and the moment in which it has decided to change its criteria, casting many doubts in a system on the fact that there were already some shadows.
